Facing Another Giant

It’s not often mentioned, but Goliath of Gath – the infamous giant brought down by a stone from David’s slingshot in one of the most famous stories of the Bible – had a brother, as huge and powerful as Goliath himself. Giants often come in pairs.

Planned Parenthood, the giant of the abortion industry, has a brother, too, when it comes to assaults on the sanctity of human life. The American Civil Liberties Union – while not as financially invested as Planned Parenthood in the termination of children in the womb – is equally determined to facilitate those deaths, in the name of protecting women’s “choice” at the expense of their physical and emotional health. Two recent examples:

Last October in Michigan, the ACLU filed a lawsuit in federal court aimed at compelling the Trinity Health hospital system and its employees to commit abortions … the staff’s religious and pro-life objections to killing babies notwithstanding. (Trinity Health, a Catholic not-for-profit organization, operates 91 hospitals and 124 continuing care facilities in 21 states.) Last month, Alliance Defending Freedom attorneys filed a motion to intervene in the case, on behalf of several pro-life, pro-women’s organizations whose members have their own stake in the outcome of the court’s decision.

“No American should be forced to commit an abortion,” says ADF Senior Counsel Kevin Theriot. “Not only is there no law that requires faith-based hospitals and medical personnel to commit such acts against their faith and conscience, but federal law directly prohibits the government from engaging in any such coercion. Similarly, the government cannot tie any funding to a requirement that hospitals and health care workers give up their constitutionally protected freedoms.”

“Forcing Catholic hospitals to perform abortions is not only against the law, it simply makes no sense,” says ADF Senior Legal Counsel Matt Bowman. “Patients should always have the freedom to choose a health care facility that respects life and to choose doctors who do not commit abortions. Other options exist for patients who prefer a different type of facility.

“Forcing health care workers to act contrary to the very faith convictions that led them into the medical profession – to serve, help, and bring healing to people – is counterproductive, unnecessary, and illegal.”

ADF attorneys are hoping for a ruling in this case as favorable to life as the one handed down by the U.S. Court of Appeals for the 9th Circuit last month. The court refused to reinstate an ACLU lawsuit (dismissed by a district court) on behalf of the NAACP. The lawsuit sought to reverse an Arizona law banning abortions based on sex or race.

“Nothing about an abortion committed on the basis of sex or race is medically necessary or constitutionally protected,” says ADF Senior Counsel Steven H. Aden. “Preserving the life of all babies, regardless of their sex or race, should be everyone’s priority.

“Sadly, for the ACLU and the NAACP, it wasn’t – but the 9th Circuit has rightly upheld the district court’s decision to dismiss their lawsuit.”

ADF attorneys joined ADF-allied attorney (and University of St. Thomas Law Professor) Teresa Collett in filing a friend-of-the-court brief with the 9th Circuit on behalf of several sponsors of the Arizona law, including multiple African-American and women’s groups.

Aborting babies out of objection to their sex or race … forcing people with sincere objections to abortion to join in the killing of babies – the ACLU’s much vaunted commitment to personal freedom clearly doesn’t extend to children in the womb, or to thoughtful adults whose moral and religious convictions run counter to the ACLU political agenda.

It’s an agenda the ACLU has been pressing hard for nearly 100 years now (as documented in our book, The ACLU v. America: Exposing the Agenda to Redefine Moral Values). Over that century, it has grown steadily into an organization of enormous, aggressive legal and political reach, with nearly unlimited financial resources. Truly, it’s a giant that will have to be defeated if we are to secure religious freedom for people of faith, and protect the health and welfare of expectant mothers and the children in their wombs.

But the Bible story gives us hope: Goliath’s brother fell just as hard he did (2 Samuel 21:19). Please join me in praying that God will provide our ADF attorneys with the resources and legal acumen we need to confront and defeat this legal giant in the courts, on behalf of you and your family.
