Fish v. Denny

Last Updated: 5/29/2020

Overview

Summary

South Jefferson Central School District officials censored a high school senior's pro-life message during the Pro-Life Day of Silent Solidarity. Scott Fish and other students attempted to communicate their pro-life viewpoints to classmates during the annual event though via T-shirts, armbands, leaflets and symbolic expression. The school's principal censored Fish and the other students because their message could make other students feel "uncomfortable," and was a violation of the so-called "separation of church and state.' After ADF attorneys filed a federal lawsuit on Fish's behalf, the school district quickly agreed to permit pro-life student speech.
