The privacy and confidence of our users and donors is important to Alliance Defending Freedom (“ADF”). This privacy policy (“Privacy Policy”) describes how we may collect, use and share information that we have obtained from or about you. For individuals or organizations that have entered into a separate engagement letter with ADF for the provision of legal services, all information disclosed pursuant to that engagement will be treated in accordance with the terms of this privacy policy, except as otherwise governed by the terms of ADF’s engagement letter ADF’s attorneys ethical obligations or other privacy terms related to the provision of legal services. This Privacy Policy governs the Website and all Services intended for use in the United States as well as all donor information from any source.

By using the Services, you are consenting to the practices described in this Privacy Policy. “You” or “your” means and refers to you as a donor or user of any of our Services. “We,” “our,” “us” or “ADF” refers to Alliance Defending Freedom and our Services.

ACCEPTANCE OF TERMS:

By accessing, downloading or otherwise using our Services, you agree to be bound by the terms and conditions of this Privacy Policy, our Terms & Conditions and any additional terms that may be applicable to you. By accessing our Services you acknowledge that you fully understand our Privacy Policy and freely consent to the collection, use and disclosure of your personal information, as described in this Privacy Policy. If you do not consent to the collection, use and disclosure practices described below, you must immediately cease any access or use of our Services. 

The definition of “personal information” will differ depending upon applicable law. In the EU/EEA and U.K. it will include all information that directly or indirectly relates to you, and includes “personal data” as defined by the General Data Protection Regulation (“GDPR”). Where the GDPR, U.K. GDPR or other EU data privacy laws apply to you, this Privacy Policy details how you can exercise your rights.

ADF’S COMMITMENTS TO MINISTRY FRIENDS:

Except as expressly set forth and explained in this Privacy Policy, ADF will not sell, rent, or make available your personal information to third parties. Our Privacy Policy clearly explains how we will use your information to further the work of ADF.

ADF spends its funds for mission impact and is transparent in how your gifts make that impact possible.  We do not  use high-pressure tactics to solicit your support, and our practice is to make communications that are truthful and accurate to the very best of our knowledge.

ADF strives to stay in compliance with applicable federal, state, and municipal laws and is governed by an independent Board of Directors.

INFORMATION COLLECTION:

Information Collected Directly From You:

ADF collects information from our users at several different points on our websites.

Registration.

In order to fully access ADF training or community websites, a user must first complete registration and application forms. During registration and the application process, a user is required to give personal information related to qualifications for the training as well as contact information, including but not limited to your first and last name, and email address.

Information Requests.

ADF also collects personally identifiable contact information when users request information or services or sign up for newsletters, including but not limited to your first and last name, email address, address, phone number, relevant organizational affiliations, and your position with such organization.  Voluntarily providing personal information about a legal matter does not create an attorney-client relationship with ADF. Online Donations.

Users must provide contact information, including but not limited to, your name, email, phone number, mailing address and financial information, such as the amount of the donation and your credit card number and expiration date, to make an online donation. ADF does not store any banking information on our systems. We utilize third-party payment processors for all online donations. The credit card information you provide is protected with current encryption tools, including SSL (Secure Socket Layer) protocols. Please call 1-800-TELLADF (1-800-835-5233) if you wish to donate to a specific program, project, or location, or if you have questions about a gift.

Surveys.

From time to time, our Website may request information from users via surveys. Participation in these surveys is completely voluntary, and the user therefore has a choice whether to disclose the requested information. The requested information typically includes contact and demographic information, including but not limited to, name, shipping address, job title, phone number, email address and zip code. Survey information generally will be used for purposes of monitoring or improving the use and satisfaction of this Website and other Services we may provide to users.

Chat Rooms, Message Boards, Social Media Platforms and Other Public Forums.

Please keep in mind that whenever you voluntarily disclose personal information online – for example on the community sites, ADF’s social media pages, message boards, through email, or in chat areas – that information can be collected and used by others. In particular, by interacting with ADF’s social media pages, or posting personal information online that is publicly accessible, you may receive unsolicited messages from other parties in return.

Information We Collect about You from Third Parties.

Media Contacts and Influencers.

ADF obtains contact details and other personal information regarding media contacts and influencers from a variety of sources including Cision. Enhancement of Marketing Profile.

We may purchase third-party marketing data and add it to our existing registered user database to better target our advertising and provide pertinent information that we think our users would be interested in. We use this information to enhance or overlay the “profile” of registered users. This aggregate marketing data is therefore tied to the users’ personally identifiable information. For additional information, see the User Profiles section below.

Personal Information We Collect From Third Parties.

We may collect personal information outside the Website from various sources, including third party data providers, payment processors and our vendors, partners and service providers. This information typically relates to our users, donors, partners or vendors and relates to our relationship or potential relationship with these parties. We may also collect information from data cooperatives and exchanges in order to enhance our donation efforts and other services.

Analytics.

We may use third party service providers to provide us with analytics on Website traffic and use of the Services. ADF uses analytic tools to analyze the performance of our Services as well as how users use our Services, including but not limited to:

Automatically Gathered Information.

Where permitted by law, and provided appropriate consent has been obtained, when required, we may automatically gather information using the mechanisms set forth below.

A cookie is a piece of data stored on your computer tied to information about your use of a website. We use necessary cookies, session ID cookies and persistent cookies. A session ID cookie is a temporary file that remains on your computer during a site visit, but expires when you close your browser. Log Files.

Like most standard website servers, we use log files. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the Website, track user’s movement in the aggregate, and gather broad demographic information for aggregate use.

Clear Gifs (Web Beacons/Web Bugs).

We employ (or our third party affiliated contractors employ) a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs), that help us better manage content on our Website by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of web users. The main difference between the two is that clear gifs reside on the website and are triggered by a user’s visit, while cookies reside on the user’s computer.

Clear Gifs can “work with” existing cookies on a computer if they are both from the same website or organization. That means, for example, that if a person visited “www.companyX.com”, which uses an advertising company’s clear gif, the website (or advertising company) would match the clear gif’s identifier and the advertising company’s cookie ID number, to show the past online behavior for that computer. This collected information would then be given to the advertising company (or website). This Website does not use other organizations’ clear gifs.

We also use clear gifs in our HTML-based emails to let us know which emails have been opened by the recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. Aggregate Information (non-personally identifiable).

We collect and create aggregated information and other non-personal information, which is not related to an identified or identifiable natural person (“Non-Personal Information”). You agree that ADF owns, without restriction, all Non-Personal Information and that you have no rights in or to any Non-Personal Information. Because Non-Personal Information cannot be used to personally identify you, you agree we may use such information for any lawful purpose.

HOW WE USE YOUR INFORMATION AND OUR LAWFUL BASIS FOR DOING SO:

Lawful Basis.

The General Data Protection Regulation (“GDPR”) and UK GDPR (“U.K. GDPR”), require a lawful basis for collecting and processing personal data about persons residing in the EU/EEA and U.K. respectively.

Consent.

We may process your personal information when you consent to the processing of such personal information for one or more specific purposes. You maintain the right to withdraw this consent at any time.

Contract.

We may process your personal information if necessary for the performance of a contract to which you are a party, or in order to take steps at your request prior to entering into a contract.

Legal Obligation.

We may process your personal information if necessary for compliance with a legal obligation to which we are subject.

Legitimate Interest.

We may process your personal information if such processing is necessary to the purposes of the legitimate interest pursued by use, or by a third party, except where such interests are overridden by your interests or fundamental rights and freedoms which require protection of personal data.

Tracking and Donor Outreach.

We have a legitimate interest in using cookies, log files, and clear gifs to enhance your experience on our Website and offer information in which you may be interested. Cookies allow us to track traffic patterns, speed up searches, and make it easier for you to find things related to previous visits. We also have a legitimate interest in using donor information to contact donors about their gifts and enhance our donor outreach. Where legally required, we will request your consent before using such tracking mechanisms. With your consent, we will use your information to keep you updated on the work of ADF and to seek support.

Registration/Application.

We use personally identifiable information collected during registration and any application process to select attendees, plan your training experience, contact you about your application or event, and maintain a relationship subsequent to the training or event. We also use this information to contact you with information pertinent to your membership in ADF online communities. Our legal basis for collecting such information is based in contract.

Information Requests.

We use personally identifiable information related to requests for information, services, or newsletters to contact users about the events, information, or services about which they have inquired. Our legal basis for collecting and using such information is based in your consent or our legitimate interest, as we have a legitimate interest in keeping you informed and providing the information you have requested.

Donor Information.

We  utilize third-party payment processors to process your online donations. We do not store any banking information in our systems. The third-party payment processors, or ADF when applicable, will use personally identifiable information collected in connection with donations for billing purposes, to process donations, and/or to contact the user if we have trouble processing a donation. Our legal basis for collecting and using such information is based in contract and our legitimate interest, in securely receiving your donation toward our charitable endeavors. We will not use this information to contact the donor for other purposes absent express consent. We will not use personally identifiable information for purposes other than those covered by the respective lawful bases on which the data is processed.

User Profiles.

We may store information that we collect through cookies, log files, and clear gifs to create a profile of our users, provided your consent has been first obtained, when required. A profile is stored information that we keep on users that details their viewing preferences. This profile is used to tailor a user’s visit to our Website and to direct pertinent information to them. We do not connect this information to identified individuals for unregistered users. The information for registered users is tied to their personally identifiable information to provide offers and improve the content of the Website for the user. Our legal basis for collecting and using such information is based in your consent, contract or our legitimate interest, to ensure that your profile is tailored to you.

HOW WE DISCLOSE AND SHARE YOUR INFORMATION:

Except for the limited purpose outlined in the Donor Privacy section below, ADF does not share or sell personal information of its constituents or donors. ADF does share personal information with its service providers, and other third parties that assist ADF in furtherance of its mission as outlined further below.

Service Providers and other Contractors.

We may disclose personal information that we collect, or you provide to service providers, contractors and other vendors we use to support our organization and who are bound by contractual obligations to keep such personal information confidential and use it only for the purposes for which we disclose it to them. We may disclose your personal information, to our trusted service providers and contractors to provide and improve the Services, facilitate and complete transactions, provide requested services, process payments, bill users, ship equipment, verify shipping addresses, analyze use of our Services, perform analytics and produce statistics on the Services, or deliver other requested services and features to you. These service providers and contractors may include, but are not limited to companies that provide mailing services, internet service providers, CRM services and mail/parcel delivery service providers.

Organizational Transfers.

In the event ADF goes through an organizational transition, such as a merger, restructuring, reorganization, being acquired by another company, or selling a portion of its assets, users’ personal information will, in most instances, be part of the assets transferred.

Legal Requirements.

As we may determine in our sole discretion, we may disclose personal information if required to do so by applicable law, including, without limitation, responding to a subpoena or request from law enforcement, court, or government agency, or in the good faith belief that such action is necessary to: (i) comply with a legal obligation; (ii) protect or defend our rights, interests or property or that of third parties; (iii) prevent, investigate, or identify possible wrongdoing in connection with the Services; (iv) act in urgent circumstances to protect the personal safety of customers, guests, or the public; or (v) protect against legal liability. 

Other Disclosures.

  • We may also disclose your personal information:

  • To enforce or apply our Terms & Conditions or any other additional terms and conditions that you have agreed to; or
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of ADF or others.

Donor Privacy.

ADF may share personal information (including name, contact information, and donation history) in the context of cooperatives managed by third-party vendors. The personal information provided is used by the third-party vendor to create a score or profile which may then be used to send solicitations on behalf of other organizations. These other organizations will not have direct or continued access to your personal information unless you choose to provide it to them directly by responding to an appeal. Sharing excludes text messaging. The data provided by individuals to receive text messages is never shared with third parties for marketing purposes. We honor opt-out requests for donors to be removed from such exchanges.

You, as a donor, may have your name excluded from any future donor list-sharing activity by emailing us directly at CorporateCounsel@ADFlegal.org or by contacting us directly at 800-835-5233.

SECURITY:

ADF takes necessary precautions to protect our users’ information, including implementing administrative, technical, and physical safeguards designed to protect personal information against theft or misuse. When our registration/donor form asks users to enter sensitive information, such as a credit card number, that information is encrypted and is protected with Secure Socket Layer (SSL) protocols. ADF’s contracts with its third-party payment processors require such third party payment processors to keep all personal information confidential, be used solely for the purposes of providing the contracted services, and maintain compliance with all applicable U.S. and international security compliance standards related to storing financial information.


While we use SSL encryption to protect credit card information online, we also protect user-information offline. We restrict access to personal information on a need-to-know basis to ministry employees, who are subject to discipline or termination for violating confidentiality, and to contractors or agents who are subject to confidentiality agreements (for example, our billing clerk or a customer service representative, or for the communities, employees who work with the community sites). Finally, the servers that store personally identifiable information are in a secure environment.

Supplementation of Information.

In order for this Website to properly fulfill its obligation to users it is necessary for us to supplement the information we receive with information from third-party sources.

ID Verification.

We may use software to verify a user’s address to avoid session hijacking, hacking attempts, or other attacks.

HOW WE PROTECT THE PRIVACY OF CHILDREN ONLINE:

Our Services may not be used by anyone under the age of thirteen (13). Our Services are not intended for or directed to minors or children under 13 years of age and no part of our Services are designed or intended to attract anyone under the age of 13. If you are under the age of 13, you are not permitted to use the Services and should immediately exit our Services. We do not knowingly ask for or collect any information from individuals under the age of 13. If you think that we have collected Personal Information from a child under the age of 13 through the Services, please contact us and we will dispose of the information.

SENSITIVE INFORMATION:

We may also collect and process certain special categories of personal information, including certain limited types of sensitive information. This sensitive information may include information about your religious or philosophical beliefs, that you explicitly consent to and voluntarily provide to us, as part of submitting a job application or seeking legal services from us. Sensitive information voluntarily provided to us related to legal matters that we are assisting you with, is treated in accordance with the ADF’s privacy practices governing its provision of legal services. You are not required to submit sensitive information in order to generally use or access our Services.

INFORMATION RETENTION:

We retain personal information for as long as needed or permitted in light of the purpose(s) for which it was collected, or as required by applicable laws and regulations.

LINKS AND THIRD PARTY SITES:

This Website may contain links to other websites, applications, and services maintained by third parties in which case the privacy policy of such third party applies and this Privacy Policy does not apply. Please be aware that ADF is not responsible for the privacy practices of such other sites. We encourage our users to be aware when they leave our Website and to read the privacy statements of each and every website that collects personally identifiable information. This privacy notice governs only ADF’s Website intended for use in the United States as well as all donor information from any source. See our Terms & Conditions for additional information. 

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. Therefore, if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

COMMUNICATIONS FROM ADF:

Special Offers and Updates.

We may send a welcome email to all users who register to verify their password and username. Established users who consent to do so will occasionally receive information on products, services, urgent issues, and our newsletter. Out of respect for the privacy of our users, you may opt to stop receiving these types of communications at any time. Please see the Choices/Opt-Out Section.

Newsletter/Marketing Communications

We will send our newsletters or other marketing communications only to those who have expressly requested them or granted permission for such contacts through their preferred channel(s). Our newsletters and marketing communications include updates on our latest projects, victories, and giving opportunities. If a user wishes to subscribe to our newsletter or other information sources, we ask for contact information, such as name and email address. You may opt out of these communications at any time. Please see the Choices/Opt-Out Section below.

Service Announcements.

It may become necessary to send out a strictly service-related announcement. For instance, if our service is temporarily suspended for maintenance, we might send users an email. Generally, registered users may not opt out of these communications, although they can deactivate their account.

Customer Service.

We communicate with users on a regular basis to provide requested services. In regards to issues relating to their account, we reply via email or phone in accordance with the user’s wishes.

CAN-SPAM Act.

We are committed to being compliant with the Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003 (“CAN-SPAM Act”). All e-mails you receive from ADF are intended to fully comply with the CAN-SPAM Act. You can withdraw your consent to receive any direct marketing communication from us by contacting using any of the methods provided below in the Choices/Opt-Out Section, or following the opt-out instructions in our email communications.

SMS/MMS Text Messaging.

By providing your phone number and opting-in on the applicable sign-up page, you are consenting to receive direct marketing, donation requests, and other commercial or informational messages by means of SMS/MMS messaging. The frequency of the messaging may vary based on your preferences. Message and data rates may apply. Data obtained through the SMS short code program will not be shared with any third-parties for their marketing purposes.

CHILD SAFETY STANDARDS POLICY:

Any explicit content or child sexual abuse and exploitation (CSAE) is absolutely prohibited on our application.

Compliance with Child Safety Laws & Reporting.

Our app complies with applicable child safety laws and regulations. Our app ensures all content shared within the app is appropriate for a mixed audience, including children. User-generated content is moderated to prevent inappropriate material from being accessible.

Any CSAM (Child Safety Abuse Material) content will be automatically removed when flagged or reported through our moderation features or if we are directly contacted for this purpose. We will systematically take action to report confirmed CSAM content to the National Center for Missing and Exploited Children. CSAM consists of any visual depiction, including but not limited to photos, videos and computer-generated imagery, involving the use of a minor engaging in sexually explicit conduct.

Privacy and Data Protection.

Our app is committed to protecting user data, especially for children under 13, in compliance with applicable regulations. Our privacy policy is displayed clearly and is accessible from the app settings and our Website. All data is encrypted during transmission and stored securely.

Ads and Monetization.

Our app does not include ads or monetized content.

Transparency and Disclosures.

Data safety: Detailed information is provided as per Google Play’s Data safety form.

Content ratings: IARC 3+, L, E, 3, 3, USK 0

Validation and Updates.

Regular internal testing is conducted to ensure compliance with Google Play’s child safety standards, including functionality reviews and content audits. Policies are reviewed quarterly or as required to align with updated child safety standards.

You have options about the various ways we collect, use and store your Personal Information.

Choices/Opt-Out.

Newsletter Opt-Out.

Our users are given the opportunity to opt in to receiving our newsletters or other information from ADF. Users who no longer wish to receive our newsletter and informational communications may opt out of receiving these communications by logging in to their user profile, calling 800-TELLADF (800-835-5233), or emailing  CorporateCounsel@ADFlegal.org. For our newsletters users can also opt-out by following the opt-out instructions in our email communications.

Data Cooperatives – Opt-Out.

Please see the form available in the Donor Privacy Section above, regarding your rights to opt-out of your personal information being shared as part of a data cooperative.

Correcting, Updating, Deleting, Deactivating Personal Information.

If a registered user’s personally identifiable information changes, such as zip code, phone, email or postal address, or if a user no longer desires our service, a user may log into their user account and use the “Edit Profile” function, email CorporateCounsel@ADFlegal.org or call 1-800-835-5233 to update or delete/deactivate the personally identifiable information.

ADDITIONAL CONSIDERATIONS FOR PERSONS COVERED BY THE GDPR AND U.K. GDPR:

If you are visiting the Website from outside the United States, please be aware that ADF is based in the United States, however we do have an international website available at adfinternational.org. All information we obtain through your use of our Services will be transferred to, processed in, and stored on our servers in the United States and/or other countries where our service providers operate. The data protection laws and regulations applicable to your personal information transferred to the United States and such other countries may be different from the laws in your country.

ADF will only transfer your personal information outside the EU/EEA or U.K. with adequate safeguards in place and in full compliance with applicable laws. We have established standard contractual clauses with our service providers to ensure they protect your information and to enforce legal transfers of data internationally.

You may have certain additional rights relating to your personal information, subject to local data protection laws. If you are located in the EU/EEA or U.K, the following rights under the GDPR or U.K. GDPR may be available to you. Certain of the information required to be provided under the GDPR is addressed in the main body of the Privacy Policy and these additional rights should be read in conjunction with the main body of the Privacy Policy. Right to Access.

You can request details of the personal information we hold about you. We will confirm whether we are processing your personal information and provide additional details including what kind of information we have about you, where we collected it, how we use it (including the legal basis for our processing), how long we expect to keep it, the categories of third parties with whom we share your information, details of any automated decision making or profiling and the safeguards regarding data transfers, subject to the limitations set out in applicable laws and regulations. If you ask us, we will provide you with a copy of your personal information free of charge. We may charge you a fee to cover our administrative costs if you request multiple copies of the same information or if the requests are manifestly unfounded or excessive.

Right to Rectification/Correction.

If you find that your personal information is out of date and needs to be edited or updated, you can ask us to update it by contacting us at  CorporateCounsel@ADFlegal.org. Please make sure to provide us with all the information we need to be able to address your request, including both the old and new information.

Right to Erasure.

At your request, we will delete or rectify your personal information if: (i) it is no longer necessary to retain your personal information; (ii) you withdraw the consent which formed the basis of your personal information processing; (iii) you have successfully objected to the processing of your personal information (see below); (iv) your personal information was processed unlawfully;  (v) we are required to delete your personal information to comply with any of our legal obligations; or (vi) the information is inaccurate and needs to be corrected. We will review requests on a case-by-case basis and we might not be able to comply with your request if we need to process your personal information: (i) for exercising the right of freedom of expression and information; (ii) to comply with our legal obligations; (iii) to establish, exercise or defend a legal claim; or (iv) to perform a task in the public interest. If we are unable to comply with your request for any of the forgoing reasons, we will notify you of the reasons why your request was rejected. Choosing to delete your personal information may impact your ability to use our Website and Services.

Right to Restrict Processing.

You have the right to request us to limit the processing of your personal information if: (i) you dispute the accuracy of your personal information; (ii) your personal information was processed unlawfully and you request a limitation on processing, rather than a deletion of your personal information; (iii) we no longer need to process your personal information, but you need your personal information in connection with a legal claim; or (iv) you object to the processing of your personal information based on our legitimate interests pending verification as to whether we have an overriding legitimate ground for such processing. To the extent needed, we may still keep some of your data to ensure we comply with your request to limit processing, or for other legal purposes.

Right to Object to Processing.

Where we process your personal information based upon our legitimate interests, you have the right to object to this processing on grounds relating to your particular situation if you feel it impacts your fundamental rights and freedoms. Where we process your personal information based upon our legitimate interests and where decisions are made by automated processing which has a legal or other significant effect on you, you may also object to such automated decision making.

Right to Data Portability.

You can request us to send you your personal information in a structured, commonly used, machine-readable format so that it can easily be transferred and used by a third party.

Right to Withdraw Consent.

We primarily rely on legitimate business interests to process your data, but to the extent we use consent to process your data, you have the right to withdraw any consent you may have given us at any time. We will comply with your request promptly. If you withdraw your consent, we might not be able to provide some of our Services to you. At any point, you have the right to object to processing of your personal information for direct marketing purposes and we will promptly comply with your request.

Before accepting your request, we may need to ask for some identifying documentation from you, to make sure we don’t inadvertently provide your personal information to someone else.If you are not in the EU/EEA, U.K., or other jurisdiction that provides these rights as a matter of law, you can still apply for any of these rights, and we may choose to comply where the request is reasonable in our discretion.

Filing a Complaint with a Data Protection Authority.

We will try to resolve any problems that you have but you are always able to contact your local data protection authority for assistance or to make a complaint.

ADDITIONAL STATE SPECIFIC RIGHTS – SUPPLEMENTAL NOTICE FOR CERTAIN STATE RESIDENTS

Your Rights Regarding Your Personal Information.

Residents of certain states, including Colorado, Delaware, Minnesota, New Jersey and Oregon, may be able to exercise certain privacy rights depending on the state in which they reside. The rights available to you depend on our reason for processing your personal information and the requirements of applicable law. Your rights will vary depending on what state you are a resident of, and whether or not the applicable state laws apply to us. Specifically, you may have the following rights:

Right to Access and Right to Know.

You can request access to a copy of the personal information that we have about you, including a list of categories of your personal information that we have collected and used over the past 12 months. We will provide to you the following information (to the extent required by law):

  • The categories of personal information we have collected about you.
  • The categories of sources from which we collect your personal information.
  • The business or commercial purpose for collecting or selling your personal information.
  • The categories of third parties with whom we share your personal information.
  • The specific pieces of personal information we have collected about you.
  • The categories of personal information that we have disclosed for a business purpose, along with the category of any other company we shared it with.
  • The categories of personal information that we have sold, along with the category of any company we sold it to. If we have not sold your personal information, we will say so.

Right to Correct Incomplete, Inaccurate, or Out-of-date Personal Information.

You may have the right to request that we correct any personal information about you that is inaccurate, by submitting a verifiable consumer request. Depending on the purpose of the processing, you also have the right to request that we complete the personal information we hold about you where you believe it is incomplete, including by means of providing a supplementary statement.

Right to Personal Information Portability.

Consistent with applicable law and subject to certain exceptions, you may have the right to request that we transfer the personal information we have collected about you to another organization, or directly to you, in a structured, commonly used, and machine-readable format, under certain conditions.

Right to Request Anonymization, Blocking, or Deletion of Personal Information.

You have the right to request the deletion of your personal information we have collected from you, subject to certain conditions and limitations under the law. Once we receive a request, we will delete (to the extent required by law) the personal information we retain about you and direct any service providers to do the same. If we determine that an exception applies, we will inform you of the reason for denying the deletion request. In some cases, deletion may be accomplished through de-identification. Please understand that if you request us to delete your personal information, our subsequent removal of such personal information may impact your ability to use our Services, and may limit your use of or participation in our Services that require your personal information.

Right to Revoke Consent.

Where we rely on your consent to process your personal information, you have the right to withdraw that consent at any time with future effect. Depending on where you are located, you may also have the right to request deletion of personal information that was processed based on your consent, or the right to know the consequences of revoking your consent. Such a withdrawal will not affect the lawfulness of the processing prior to the consent withdrawal.

Right to Object to Automated Decision-Making/Profiling.

You may have the right to object to our processing of your personal information, under certain conditions, and we can be required to no longer process your personal information.  Such right to object may apply if we collect and process your personal information through automated decision making, such as profiling, to better understand your interests in our products and services or for direct marketing.  If you have a right to object and you exercise this right, your personal information will no longer be processed by us for such purposes.  Such a right to object may, in particular, not exist if the processing of your personal information is necessary to take steps prior to entering into a contract or to perform a contract already concluded.

Right to Opt-out of the Sale of Personal Information.

You have the right to opt-out of the sale of your personal information. ADF may sell personal information as part of its participation in context of data cooperatives managed by a third party vendors. To exercise your right to opt-out please use the methods offered in the Donor Privacy section.

Right to Opt-out of Sharing of Personal Information for Certain Processing (Profiling/Targeted Advertising).

Consistent with applicable law, you may have the right to opt-out of having your personal information shared for purposes of targeted advertising. You may also have the right to request further information about the disclosure of your personal information for those third parties’ marketing purposes, such as the contact information of those parties, once per calendar year. We do not currently share your personal information for such purposes. If this changes, we will notify you, and you may have the right to restrict such sharing.

Right to Non-discrimination for Exercising a Privacy Right.

We will not discriminate against you for exercising any rights. This generally means we will not deny you goods or services, charge different prices or rates, provide a different level of service or quality of goods, or suggest that you might receive a different price or level of quality of goods.

Right to Disclosure of Direct Marketers.

You may have a right to the categories and names/addresses of third parties that have received personal information for their direct marketing purposes upon simple request, and free of charge, if any.

Global Privacy Control.

Global Privacy Control is a browser setting that allows you to notify websites you visit about your privacy preferences. At this time, ADF is not required to honor Global Privacy Control signals.

Exercising your Rights; Verification of Requests.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. Certain states require that we verify the identity of each person who makes a request to know what personal information we have about you or to delete the personal information we have about you.

In some regions you may request this information no more than two times in a rolling twelve-month period. When you make this request, the information provided may be limited to personal information we collected about you in the previous 12 months.

All requests must provide sufficient information to allow us to reasonably verify you are the person whom we collected personal information about or an authorized representative of such person. We will respond to your verifiable request within the prescribed timelines. We will only use the information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. Please describe your request with sufficient detail to allow us to properly respond to it. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Appeals.

If we deny your verifiable request to exercise your applicable privacy rights on your behalf, in some locations you may have the right to appeal our decision. To initiate an appeal, please submit a written request to us within thirty (30) days of receiving our denial notice. We will review your appeal and respond within thirty (30) days of receipt of your appeal. If your appeal is denied, we will provide an explanation for the denial and inform you of any further rights you may have.

De-Identification.

Consistent with applicable law, we commit to maintain and use anonymized information in de-identified form and not to attempt to re-identify the information, except that we may attempt to re-identify the information solely for the purpose of determining whether its de-identification processes satisfy the requirements of applicable state laws.

Do-Not-Track Disclosures; Third-Party Tracking.

Certain mechanisms may allow you to send web browser signals, known as “Do Not Track” (“DNT”) signals, indicating your choice to disable tracking on websites. We do not respond to browsers do not track signals currently. We may not be aware of or able to honor and respond to every such mechanism. More information about “do not track” is available at www.allaboutdnt.org concerning such information.

Third parties, other than our service providers and vendors, do not have authorization from us to track which websites, or other online services you visit prior to and after visiting our websites. Please note, however, that we cannot control third-party tracking and there may be some third-party tracking that occurs without our consent or knowledge.

Shine the Light Request.

California Civil Code § 1798.83 permits residents of California to request from ADF a notice disclosing: (1) the categories of personal information we have shared with third parties, if any, for the third parties’ direct marketing purposes, during the preceding calendar year, and (2) the names and addresses of those third parties. NOTIFICATION OF CHANGES:

We reserve the right to change the terms of this Privacy Policy at any time. If we change our privacy policy, we will post those changes to this privacy statement, provide a notice that changes have been made on the home page of our Website, and other places we deem appropriate, so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.
