Summary
New York state taxpayers represented by ADF attorneys filed suit against Westchester County Executive Andrew Spano in 2006, alleging that he acted illegally when he ordered that the county must extend benefits reserved for legally married couples to out-of-state same-sex "marriages." In a second suit filed the same year, taxpayers alleged that New York State Comptroller Alan Hevesi acted illegally in his role as head of the New York State and Local Retirement System when he decided to recognize out-of-state same-sex marriages that involve members of the retirement system.
