ADF attorney available to the media following hearing in Bronx equal-access case

NEW YORK — Alliance Defense Fund Senior Counsel Jordan Lorence will be available to answer questions from the media at the U.S. Court of Appeals for the 2nd Circuit following a hearing Thursday in Bronx Household of Faith v. Board of Education of the City of New York.  Lorence will argue that the district court’s November 2005 decision to issue a permanent injunction against the city should stand so that the church can continue to rent a public school facility.

"Christian groups simply wanting to rent public facilities like anyone else should not be treated as second class.  The U.S. Supreme Court ruled long ago that access to public school facilities is as much a right for religious groups as it is for other groups,” said Lorence.  “The school board cannot slam the gate on religious groups while throwing it open for others.”

For more than a decade, the New York City Board of Education has fought to keep Bronx Household of Faith, represented by ADF attorneys, from renting school facilities for Sunday meetings.  The board has claimed such action would violate the so-called “separation between church and state.” That claim was rejected last November by the U.S. District Court for the Southern District of New York.

The U.S. Department of Justice has issued a brief in support of Bronx Household of Faith in the case.
