Summary

Daniel Burritt, who owns a construction company, placed a tractor-trailer displaying a gospel message on his private business property, which is located along a public highway. New York Department of Transportation officials informed Burritt that the trailer, which is used to store supplies for his business, was a “public nuisance,” and that it would be forcibly removed if the Christian message remained visible from the highway. After ADF attorneys filed suit on behalf of Burritt, NYDOT officials agreed that the tractor would be permitted to remain on the property.
