Free speech fairness language clears House as part of tax bill
The following quote may be attributed to Alliance Defending Freedom Legal Counsel Christiana Holcomb regarding the U.S. House of Representatives’ approval Thursday of tax legislation that includes language from the Free Speech Fairness Act, which, if signed into law, would prevent the Internal Revenue Service from investigating and penalizing churches simply for what a pastor says from the pulpit:
“America’s pastors don’t need a federal tax agency to police their sermons, and so we commend those in the House who supported free speech fairness language in the amended tax bill. Churches and their pastors have a constitutionally protected freedom to decide for themselves what they want to say or not say. Recent polling demonstrates that religious leaders don’t want to be burdened by the continual threat of an IRS investigation and potential penalties based simply on what they say from the pulpit.”
The approved language allows statements to be made in the ordinary course of a 501(c)(3) organization’s regular and customary activities, so long as the organization does not incur more than minimal incremental costs.
