The following quote may be attributed to Idaho Attorney General Raúl Labrador regarding the U.S. Supreme Court’s decision Friday to stay a lower court ruling that held that the Biden administration could misuse the federal Emergency Medical Treatment and Labor Act to force emergency room doctors to perform abortions in violation of Idaho’s Defense of Life Act in State of Idaho v. United States of America. The court agreed to review the case and the administration’s attempts to require emergency room doctors to harm women and take the lives of their unborn children. The Idaho Attorney General’s Office, together with attorneys from Alliance Defending Freedom and Cooper & Kirk, asked the high court to respect Idaho’s law safeguarding women and their children and ensure that the administration did not misuse federal law to force emergency rooms doctors to deny life-saving care to vulnerable patients:
“We are very pleased and encouraged by the Supreme Court’s decision today. The federal government has been wrong from day one. Federal law does not preempt Idaho’s Defense of Life Act. In fact, EMTALA and Idaho’s law share the same goal: to save the lives of all women and their unborn children. Today, the Supreme Court’s decision is a big step in stopping the administration’s lawless overreach. The people of Idaho have spoken with clarity on the issue of life.”
