The government shouldn’t have the power to decide what’s true when politics are being discussed. And the Constitution says government officials can’t censor anyone just because they disagree with what they have to say.
But New Mexico has a law that does just that—targeting and censoring political speech that includes satire, parody, and commentary if state officials deem it “deceptive.” This puts the world’s second-most popular satire website, The Babylon Bee, directly in the state’s crosshairs.
Under this law, The Bee is forced to use government-scripted disclaimers on its jokes, saying: “This [media] has been manipulated or generated by artificial intelligence.” The Bee often uses AI to produce images to illustrate its humorous fake-news stories.
Talk about killing the joke. If you can be punished for a meme, you’re not living in a free society.
New Mexico’s law claims to guard against misinformation and deception, but it’s really about control. There are already laws that prevent people from using AI to defame or defraud others. This one paves a path for widespread censorship, allowing the government to determine what speech is acceptable and what isn’t.
That’s antithetical to the American way. And it’s blatantly unconstitutional.
It’s also not the first time the government has tried to control the narrative.
