Supreme Court punts on educational freedom. 4-4 split leaves in place a lower court ruling.
Religious organizations deserve the same access to public benefit programs as other private organizations—equally and without discrimination.
This principle led the Oklahoma Statewide Charter School Board to approve St. Isidore of Seville Virtual Catholic School’s charter application. Other than the program’s exclusion of religious schools, the school met all qualifying criteria and offered disadvantaged children in the state an excellent educational opportunity.
However, Oklahoma Attorney General Gentner Drummond filed a lawsuit to exclude St. Isidore from the charter-school program solely because it is religious.
This case is not just about St. Isidore—it’s about standing against discrimination against people of faith.
Although the Supreme Court’s decision means St. Isidore won’t be a free option for Oklahoma families, the Court did not directly address the legal issues and left the door open for future victories.
