SAN FRANCISCO — Alliance Defense Fund Senior Counsel Glen Lavy will be available to answer questions from the media during a press conference Monday at the California Court of Appeal.  The press conference will follow his oral arguments defending California marriage laws that recognize marriage as a union between one man and one woman only.

“Marriage has become an extremely emotional issue because special interests are trying to turn a legal issue into a political one,” said Lavy.  “What we’re really discussing here is whether we’re going to let political special interest groups or the law define marriage.  And the law passed by California voters in 2000 defines marriage as the union of one man and one woman.”

In March 2005, Superior Court Judge Richard Kramer declared the state’s marriage laws unconstitutional, finding “no rational purpose” to “limit” marriage to the union of one man and one woman.  Voters overwhelmingly passed Proposition 22, California’s Defense of Marriage Act, in 2000.  ADF attorneys filed the lawsuit Proposition 22 Legal Defense and Education Fund v. City and County of San Francisco to defend California voters.  The suit is one of six marriage cases that the court consolidated on appeal.

“Activists may try to redefine marriage to mean anything, everything, and ultimately nothing, but ADF is prepared to continue to defend what marriage is, always has been, and always will be--a union between one man and one woman,” said Lavy.
