
The following quote may be attributed to Alliance Defending Freedom Senior Counsel and Vice President of Appellate Advocacy John Bursch regarding a friend-of-the-court brief ADF attorneys filed with the U.S. Supreme Court in Stitt v. Fowler, in which Oklahoma is defending its law that requires its state birth certificate records to reflect biological sex:
“The late Supreme Court Justice Ruth Bader Ginsburg famously recognized that the ‘inherent’ and ‘enduring’ differences between men and women ‘remain cause for celebration.’ At a time when activists are pushing a dangerous ideology—in this case, that someone’s so-called ‘gender identity’ determines their sex—Oklahoma’s law ensures that the state’s vital records accurately reflect biological reality. Accurate state records promote public health and safety, protect people’s privacy in sex-specific spaces, and provide equal opportunities to women and girls by acknowledging biological reality. The law and Supreme Court precedent define sex in biological terms, and nothing in our Constitution authorizes individuals to demand that a state change its records to reflect their professed gender identity. We urge the Supreme Court to respect a scientific truth that is important in the context of medicine, military service, sports, and education.”
