Summary

ADF-allied attorney Tom Marcelle filed suit against the State University of New York at Albany after officials unfairly allocated mandatory student fees. As a result of the university's practices, conservative and Christian student groups on campus were effectively excluded from receiving the same funding as other groups. In its ruling, the U.S. Court of Appeals for the 2nd Circuit agreed, stating that it is unconstiutional for for universities to allocate mandatory student fees to student groups by referendum; essentially, using majority rule to determine which groups will receive the funding.
