Case Summary
The Oklahoma Supreme Court ordered the Oklahoma Statewide Charter School Board to exclude St. Isidore of Seville Catholic Virtual School from the state’s charter school program solely because St. Isidore is religious.
Religious organizations should be afforded the same access to public benefit programs as other private organizations—equally and without discrimination. But soon after he was elected, Oklahoma’s Attorney General Drummond filed a lawsuit to bar St. Isidore from participating in the charter school program—just because it’s a religious school. This is a blatant act of discrimination against religious organizations in the state and people of faith. That’s why this case is now before the U.S. Supreme Court.
This case is not just about St. Isidore—it’s about standing against discrimination against people of faith. Winning this case at the Supreme Court could impact every American because it could open the door for faith-based charter schools across the country. It would be a significant win for both religious freedom and school choice.

Behind the Case
Oklahoma should be able to choose the best schools for its charter school program, and the U.S. Constitution prohibits the state from excluding schools from that program simply because they are religious.
Why Choices in Education Matter
Different children flourish in different environments, and providing a wide variety of options allows parents to choose the best education for their children. Everyone should want more high-quality, no-cost education options for families.
