Updates: Volume IV, Issue 1
Alliance Defense Fund lawyers are still awaiting a decision that will let them move forward in Cenzon-DeCarlo v. The Mount Sinai Hospital at the Kings County Supreme Court of New York. Cathy DeCarlo is a New York City nurse suing the hospital for compelling her to participate in an abortion, despite her faith convictions (Volume III, Issue 2). In late November, the U.S. Court of Appeals for the 2nd Circuit upheld the dismissal of Cathy’s federal (not Kings County) case – a case with profound implications for the "rights of conscience" of medical workers nationwide. ADF attorneys also intervened on Cathy’s behalf in State of Connecticut v. United States, in which Planned Parenthood and its allies and the Obama Administration are threatening to repeal regulations that enforce Cathy’s conscience rights.
In A Lonely Place
A decision is also being awaited in the case of Centro Familiar Cristiano Buenos Nuevas Christian Church v. City of Yuma (Volume III, Issue 3), heard last spring in federal court. The church is suing the city for denying it the right to meet in a downtown building, as non-religious assemblies are allowed to do. The church still holds a mortgage on the property, which it can no longer use.
