Summary

The Biden administration issued a mandate via the Occupational Safety and Health Administration that requires all private employers of 100 or more employees to force unvaccinated employees to receive a COVID-19 vaccine, be subject to weekly testing and masking requirements, or lose their job. Bishop O’Gorman Catholic Schools in South Dakota, the Christian Employers Alliance, based in North Dakota, and Home School Legal Defense Association joined several states in filing a petition with the U.S. Circuit Court of Appeals for the 8th Circuit to challenge the legality and constitutionality of this vaccine mandate.

On November 5, ADF filed an emergency motion to immediately halt enforcement of this OSHA mandate.

On November 16, a random lottery was held by the U.S. Judicial Panel on Multidistrict Litigation, and the U.S. Court of Appeals for the 6th Circuit was chosen to decide all qualified lawsuits challenging the federal government’s private employer vaccine mandate issued by OSHA.
